General Terms and Conditions
1. Scope of Terms and Conditions
These terms and conditions apply to contracts for the renting of rooms, seminar rooms, other event rooms as well as services rendered in connection with the educational mandate by the »European Youth Education and Meeting Centre in Weimar« (EJBW).
General terms and conditions of the guest only apply if this has been expressly agreed in writing beforehand.
2. Formation of the contract
Unless otherwise specified in the respective offers of the EJBW, the contract is concluded by written confirmation from the contractual partner.
3. Services
The scope of services results from the service description and from the information in the offer. Verbal collateral agreements that change the scope and content of the contractually agreed service require express written confirmation.
Organizational or content changes that become necessary during the implementation of the occupancy or event can be made if they do not affect the overall layout of the contract or if they are expressly approved.
When booking rooms, bed linen is provided free of charge. Towels are to be brought by the guest. These can be borrowed for a fee.
4. Prices
The prices for the booked services result from the price list valid at the time of the contract and the valid seminar announcement.
Unused individual services do not lead to a reduction in the agreed prices. Buffets, receptions and the like thereof are not covered and therefore to be paid extra.
All services and goods claimed separately by the guest will be charged extra. Fees, which are collected by third parties, must be paid directly by the guest as a debtor.
Culture Tax
The city of Weimar charges a culture tax per night of currently €2.25 in a double room and €3.00 in a single room for guests who have reached the age of 18. The amount of this culture tax may change and the EJBW does not have any influence on it. This tax does not apply if the overnight stay is predominantly required for professional reasons. The EJBW is obliged to collect this culture tax and pass it on to the city of Weimar.
5. Cancellation by the guest
Cancellation of the contract is free of charge up to 12 weeks before the booked date.
If a cancellation is made up to four weeks before the start of the booking, the EJBW will charge a cancellation fee of 50%; in case of later cancellation less than four weeks before the date, 80% of the contractually agreed price for accommodation and meals will be charged.
6. Withdrawal by the EJBW
If, due to an important reason that the EJBW is not responsible for, the provision of the contractually owed service is impossible or if there is the risk of an impossibility occurring at the time of the service, the EJBW is entitled to withdraw from the contract without this resulting in a claim for damages.
These important reasons could be, for example, force majeure, severe weather, strike, fire and the like.
There is a right of withdrawal that can be exercised at any time, if there is any fear that the occupancy or the event can endanger the smooth running of the business, the security or the reputation of the EJBW in public.
In the aforementioned cases there is no claim for compensation.
Otherwise, the statutory provisions apply.
7. Arrival and departure
On the day of arrival, the rooms are usually available from 3 p.m.
In the case of previous arrivals or in the event that the rooms should not be ready for occupancy in exceptional cases, it is possible to leave the luggage in the house separately; liability for loss or damage cannot be accepted.
Rooms must be vacated by 9 a.m. on the day of departure and the keys returned. After returning the keys, the guest/supervisor takes an inspection tour of the rooms. Depending on the number of participants, a suitable amount of time should be allocated for this inspection.
If an earlier departure is intended, then sufficient time must also be planned for a proper acceptance of the rooms.
8. Liability
While participating in seminars and offers, including trips and excursions offered and organized by the EJBW, as well as during the stay on the premises and on the property, the liability for damages suffered by the guest is limited to intent and gross negligence. Any further liability is excluded.
The EJBW does not accept liability for the loss, damage or theft of items brought by the guest.
The guest is liable to the EJBW for damage and consequential damage caused by himself/herself, his/her employees, speakers, participants or commissioners.
Damages to the property of the EJBW or to things which do not belong to the guests must be reported to the reception immediately after becoming aware of them.
The loss of a key as well as causing it to be unusable will be invoiced with an amount of €35.00 per key.
An increased cleaning effort caused by excessive soiling or by smoking in the room is to be compensated with a flat rate of €80.00 per room. This flat rate does not apply if it can be demonstrated that a higher effort has to be made and this results in higher costs.
Items that have been forgotten by the guest are kept by the EJBW for a period of 3 months. These can be picked up by the guest within this period or the forwarding of item(s) can be arranged. For this, the guest has to bear the cost and the risk of loss of the goods on the shipping route.
9. Fire
The lighting of open fire (especially candles, tea lights, sparklers) is prohibited.
10. Authorization and permissions
The guest himself/herself must independently inform the authorities and apply for official permits required for an event. Appropriate permits must be obtained in good time and at one’s own expense.
11. Pets
Pets are not allowed. If necessary, we will be happy to put you in touch with a pet boarding facility nearby.
12. Protection of young persons
The EJBW is an educational institution, which mainly fulfills its mission towards young people.
The EJBW and its entire site is a non-smoking facility.
The Youth Protection Act applies on the premises and at events; therefore the consumption of alcohol is generally prohibited for young people under the age of 16. The legal protection regulations apply to young people between 16 and 18 years of age.
If compliance with the Youth Protection Act cannot be guaranteed on the part of the young guest, the EJBW reserves the right to a complete and general ban on alcohol. In the event of repeated significant violations, the EJBW has the right to withdraw from the contract without being obliged to pay compensation.
13. Data protection
The EJBW collects, processes and, if necessary, uses the personal data of the registered participants using service providers. The data will not be passed on to third parties.
14. Severability clause
Should individual provisions of these conditions be ineffective or unenforceable, the remaining clauses remain unaffected.
